House GOP Threatens Subpoenas Over Sanctuary DA Policies
The House Judiciary Committee is signaling a readiness to issue subpoenas if district attorneys accused of leniency toward undocumented immigrants do not cooperate with its investigation. Chairman Jim Jordan, R-Ohio, stated that the committee is examining the practices of prosecutors in so-called “sanctuary jurisdictions” who allegedly consider immigration status when handling criminal cases, irrespective of whether the alleged offense relates to a person’s legal standing in the country.
Investigation into Sanctuary Policies
Chairman Jordan outlined the committee’s approach, explaining that the process typically involves requests for information, followed by reiterations and explanations of the need for the data. He indicated that if cooperation is not forthcoming, the committee is prepared to escalate to subpoenas to obtain necessary documents. “We want to know the facts,” Jordan emphasized in a recent interview.
A particular focus of the committee’s inquiry is Steve Descano, the District Attorney for Fairfax County, Virginia. Descano has come under intense scrutiny following the tragic stabbing death of Stephanie Minter, a 41-year-old U.S. citizen. The individual accused in Minter’s killing reportedly entered the U.S. illegally from Sierra Leone in 2012. According to the Department of Homeland Security, the suspect had a history of over 30 arrests prior to the incident.
Descano’s Policies and Fairfax County
Descano, who has led the Fairfax County District Attorney’s Office since January 2020, implemented plea bargaining guidelines that year. These directives advised prosecutors to “consider immigration consequences where possible” and to evaluate “the collateral immigration consequences of the specific crime(s) the defendant is charged with,” as reported by local news outlet WTOP News. Fairfax County operates as a sanctuary jurisdiction, a designation that means local law enforcement agencies are not mandated to collaborate with federal immigration authorities.
