Family Sues After Badminton Racket Tragedy Claims 6-Year-Old’s Life

A New Jersey family has filed a wrongful death and product liability lawsuit against the maker of a badminton racket, alleging a defect in the equipment led to the tragic death of their 6-year-old daughter, Lucy Morgan, during a summer vacation in Maine. The lawsuit claims the racket failed during normal use, transforming its metal shaft into a projectile that fatally pierced the child’s skull.

A Vacation Turned to Tragedy

The devastating incident occurred on June 1, 2024, in Limerick, Maine, where Lucy was vacationing with her parents and siblings. According to the Maine State Police, Lucy’s 10-year-old brother was playing badminton outside when the aluminum shaft of the racket unexpectedly detached from its wooden handle. In a horrific turn of events, the dislodged shaft struck Lucy in the head, penetrating her skull.

Emergency services rushed Lucy to Southern Maine Health Care in Sanford. She was subsequently airlifted to Maine Medical Center in Portland, where she succumbed to her injuries on June 5, 2024. The family’s attorney, Charles P. Hehmeyer, described the event as a parent’s worst nightmare, stating, “The Morgan family was enjoying an idyllic summer vacation here in Maine when they lost Lucy due to what we allege was a dangerous and defective piece of sports equipment.”

Allegations Against Franklin Sports

The lawsuit, a copy of which was reviewed, names Massachusetts-based Franklin Sports as the defendant. It asserts that the badminton set, which had been provided at the rental cottage, was defective and unreasonably dangerous. Specifically, the complaint alleges that the racket’s handle and metal shaft were not properly secured, the adhesive used to join these components was insufficient, and the design lacked a crucial secondary restraint mechanism that could have prevented the shaft from becoming a projectile.

Furthermore, the family contends that Franklin Sports failed to adequately warn consumers about the potential risks associated with the product. Attorney Hehmeyer indicated that this was not an isolated incident for the company. He stated that Franklin Sports had prior knowledge of a similar incident where a child in New York reportedly lost an eye due to a racket separating, yet the company allegedly failed to implement corrective measures.

“The company knew that but chose not to correct this with something as simple as a pin in the handle, which would cost pennies,” Hehmeyer told reporters, emphasizing the perceived negligence in the company’s response to known safety issues.

Seeking Justice and Damages

The lawsuit seeks both compensatory and punitive damages, although a specific monetary amount has not been detailed in the initial complaint. The family is pursuing compensation for funeral expenses, severe emotional distress, and the loss of comfort, society, and companionship. The legal filing also notes that Lucy’s three siblings witnessed the traumatic event and have suffered significant emotional distress as a result. Her parents, hearing her screams, rushed to her aid.

A Pastor’s Faith Amidst Grief

Lucy’s father, Jesse Morgan, is a pastor at Green Pond Bible Chapel in Rockaway, New Jersey. He shared in the days following the tragedy that the family had been enjoying their last full day at the lake cottage when the children decided to play badminton. Amidst their profound grief, Jesse Morgan found solace in his faith.

He recounted how a friend returned Lucy’s backpack after the family had returned home. Inside, he discovered a prayer journal Lucy had received about a month before her death. The journal contained drawings, Bible-themed notes, and reflections on her faith. Jesse Morgan expressed his conviction that Lucy “loved Christ and loved God” and is now in heaven. He described finding the journal as one of the most beautiful gifts during their time of loss, believing his daughter possessed “the faith of a mustard seed.”

The lawsuit aims to hold Franklin Sports accountable for the alleged defects in their product and the devastating consequences that followed, seeking to ensure such a tragedy does not befall another family.
