Maine ICE Shooting Victim Not Target of Arrest Warrant, Senator’s Office Clarifies

A man fatally shot by an Immigration and Customs Enforcement (ICE) agent in Biddeford, Maine, on Monday was not the individual named in the arrest warrant federal agents were attempting to execute, according to a clarification from Senator Angus King’s office. This development marks a significant revision to information previously relayed to the senator by Homeland Security Secretary Markwayne Mullin.

Revised Information on Arrest Warrant Target

Senator King, I-Maine, confirmed in an interview that Secretary Mullin contacted him to correct earlier details. Mullin initially informed King that the deceased individual was indeed the subject of the warrant. However, Mullin later called back to state that subsequent information indicated the victim was not the intended target of the federal operation.

“When I first talked to him, he said the person was the target of the warrant. He called me back. He initiated a call to me to say he had learned subsequently that he was not the target of the warrant,” King explained. “So he corrected the information he had.”

Earlier on Monday, King had told reporters that Mullin had indicated the man killed in Biddeford, a coastal city approximately 15 miles southwest of Portland, was the subject of an immigration enforcement action and had been ordered to leave the United States. At that time, King had stated the individual, described as a male in his 20s, had been issued a removal order and was shot by an ICE agent after allegedly attempting to flee in a vehicle, which the secretary termed “weaponized.”

In a statement provided to news outlets, an ICE spokesperson detailed the agency’s account of the events. Agents were reportedly conducting surveillance at the last known address of an undocumented immigrant with a final order of removal. The individual departed the residence in a vehicle, prompting ICE law enforcement to attempt a stop.

According to ICE, the vehicle attempted to flee the scene. “Fearing for public safety an officer discharged his weapon,” the spokesperson stated. The driver of the vehicle sustained injuries and was transported for emergency medical services, but ultimately passed away. The Biddeford Police Department and the FBI responded to the scene, and the Department of Homeland Security’s Office of Inspector General (OIG) was notified. ICE indicated that the discharge of a firearm would be investigated and that updates would be provided as more information became available.

King also expressed concern over the apparent lack of body camera footage from the ICE agents involved, stating, “one of the problems is apparently – and again, everything I’m saying is what I know now, certain facts may come out – but apparently there are no cameras. Body cameras were not on the agents. So we have no video evidence of what occurred in this case.”

King stated his intention to monitor the process closely, invoking the principle of “trust but verify.” He stressed the importance of determining whether the actions of the vehicle’s driver justified the use of deadly force, noting that this would be a central question for investigators.

“And the question is, what did he do with his vehicle? Were officers threatened? Was this were the threats rising to the level that justified deadly force? That’s what this investigation is all about,” King said. He added his commitment to ensuring the investigation remains transparent and thorough, and that state and local officials are involved.

Following the incident, protesters gathered outside the office of Senator Susan Collins, R-Maine, expressing anger and demanding answers from ICE. The Maine Immigrants’ Rights Coalition and Presente! Maine identified the deceased as a 26-year-old Colombian man. In a joint statement, the groups mourned the loss, stating, “He was a member of our community, a neighbor, and a human being whose life was cut tragically short.” They called for accountability and a transparent account of the events.

Governor Janet Mills, D-Maine, confirmed she had been briefed on the incident involving federal law enforcement and stated that state police were cooperating with the investigation.
